The petitioner is languishing in custody since 31.12.2015 in a case registered for the offences punishable under Sections 20 and 22 of the NDPS Act.

From the hutment of the petitioner 1.800 kgs. Ganja were recovered.

It is submitted by learned counsel for the petitioner that the recovery was made from a hutment. The recovery is between small and commercial quantity and a statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Patna High Court Cr.Misc. No.15693 of 2016 (2) dt.11-04-2016 2/2 Learned APP has not disputed the quantum of recovery and the fact that the investigation has already concluded.

Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Patna in connection with Kankarbagh P.S. Case No. 877 of 2015. The learned court below will be at liberty to cancel the bail bonds of the petitioner in two eventualities i.e. if he defaults for three consecutive occasions or substantially gets involved in similar nature of offence.
