Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Alipur P.S. Case No. 26 of 2021 lodged under Sections 302, 201/34 of the I.P.C.

As per the prosecution case, the death of sister of the informant took place on her Sarural. The allegation of demand of dowry and one motorcycle was there. It is also the allegation that the dead body has been evaded by the accused person. Learned counsel for the petitioner submits that the petitioner is a distant relative. It transpires that he is (Bahnoi) brother-in-law of the husband of the deceased who resides at the

Learned counsel for the petitioner further submits that petitioner is in custody since 07.02.2022 having clean antecedent, charge sheet has already been filed in this case. He further submits that relative of Tuntun Yadav has been granted bail by the Co-ordinate Bench of this Court vide order dated 10.03.2022 passed in Cr. Misc. no. 40203 of 2021 Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned court of Sri Aman Papnai, Judicial magistrate, 1st Class, Gaya in connection with Alipur P.S. Case No. 26 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

With this observation, the bail application stands allowed.
