JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 08-04-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is an accused in connection with Aurangabad Town P.S. 58 of 2016 registered under Section 414 of the Indian Penal Code, pending in the court of Chief Judicial Magistrate, Aurangabad.

The accusation is of recovery of theft motorcycle (Hero Honda) bearing registration no. BR 26G 8212 from the house of the petitioner.

Learned counsel for the petitioner submits that petitioner is the bona fide purchaser of the said motorcycle from Buta Thatera, and has been falsely been implicated in this case

Patna High Court Cr.Misc. No.13625 of 2016 (2) dt.08-04-2016 mere on suspicion. Further submission is that petitioner having no criminal antecedent and is in custody since 18.02.2016. Taking into consideration the facts and circumstances of the case and the nature of allegation, I am not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner is rejected.
