JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 12-08-2015 In these two applications filed under section 438 of the Code of Criminal Procedure, the respective petitioners seek anticipatory bail in connection with Chandradip P.S.Case No. 70 of 2014 registered for the offences punishable under sections 302 read with 34 and 120-B of the Indian Penal Code as well as section 27 of the Arms Act.

No.8923 of 2015 (7) dt.12-08-2015 2/2 According to the FIR, the brother of the informant, namely, Pramod Yadav was intercepted by altogether nine persons named in the FIR including petitioner Janardan Yadav, who made indiscriminate firing upon him causing several gun shot injuries, as a result of which Pramod Yadav died on the spot. In course of investigation, it transpired that at the relevant time the petitioner Deonandan Yadav was driving the Bolero vehicle on which the miscreants were moving.
Considering the gravity of the offence, I am not inclined to grant anticipatory bail to the petitioners. Accordingly, their prayer for anticipatory bail is rejected. In case the petitioners surrender and seek bail, the same shall be considered on its own merit without being prejudiced in any manner by the order passed by this Court.
