L.P.A. No. 1278 of 2018
Patna High Court L.P.A No.1278 of 2018 dt.04-11-2022 2/3 With the consent of the learned counsels for the respective parties matter is taken up for final disposal. The appellant has assailed the order of the learned Single Judge dated 06.08.2018 passed in CWJC No. 7614 of 2016. Appellant-Beli Kumari and seventh respondent Punam Devi were candidates for the post of Anganwadi Sewika and seventh respondent was selected and appointed. Feeling aggrieved and dissatisfied with the appointment and selection of seventh respondent appellant-Beli Kumari filed C.W.J.C. No. 7614 of 2016.
The sole ground contended by the appellant is that seventh respondent-Punam Devi education certificates were not genuine whereas before the learned Single Judge counter affidavit has been filed on behalf of official respondents and so also authorities of Bihar Sanskrit Sikhsa Board who have confirmed the certificates of Punam Devi are genuine. The same has been taken note off by the learned Single Judge while rejecting C.W.J.C. No. 7614 of 2016. Still aggrieved by the order of the learned Single Judge the appellant has presented this appeal. In support of L.P.A. the appellant has not produced any material information so as to overcome the counter affidavit filed by the official respondents read with the confirmation of the certificate of Punam Devi-respondent that certificates are genuine.
Patna High Court L.P.A No.1278 of 2018 dt.04-11-2022 3/3 It is to be noted that such confirmation is by the Bihar Sanskrit Siksha Board. The appellant has not produced any contrary documents in order to overcome the stand of the official respondents selecting and appointing authority-Bihar Sanskrit Siksha Board.
In the light of these facts and circumstances, the appellant has not made out a case so as to interfere with the learned Single Judge order dated 06.08.2018 passed in C.W.J.C. No. 7614 of 2016.
Accordingly, the present Letters Patent Appeal No. 1278 of 2018 stands dismissed.
