JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-04-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. According to prosecution case itself, the petitioner is not assailant and, at best, it can be said that he instigated the other accused to kill the deceased. Petitioner is in jail custody since 05.12.2013 and as per submission, up till now, only charge could be framed against him.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with
