The petitioner seeks bail in connection with East Colony P.S. Case No. 10 of 2019 registered under Section 20/22 of the NDPS Act.

It is submitted by the learned counsel for the petitioner that from perusal of the seizure list itself it would transpire that the recovery of 1.75 kg ganja was made from the shop run by co-accused Mantu Tanti. The petitioner is a lady inmate of the family. She has got no concern with the alleged incriminating ganja. Her name as well as name of one Gautam Kumar has been given in the FIR only because they happen to be family members of Mantu Tanti. The said Mantu Tanti has already been granted bail by a Bench of this Court vide order dated 15.03.2019 passed in Cr.Misc. No. 16178 of 2019.

Patna High Court CR. MISC. No.33668 of 2019(2) dt.22-05-2019 2/2 Learned counsel appearing for the State opposed the application for grant of bail to the petitioner. However, he concedes that the case of the petitioner stands on similar footing to that of Mantu Tanti, who has been granted bail by this Court. Considering the submissions made on behalf of the parties, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Munger in connection with East Colony P.S. Case No. 10 of 2019, subject to the conditions : (a) that the petitioner shall attend court in accordance with the conditions of the bond executed;

(b) that the petitioner shall not commit an offence similar to the offence of the present case; and (c) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
