JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 19-04-2016 Heard learned counsel for the petitioner and learned counsel for the State.

Petitioner is accused in connection with Araria (Bairgachhi) P.S. Case No. 381 of 2015, G.R. No. 2234 of 2015 registered under Section 395 of the I.P.C.

Learned counsel appearing on behalf of the petitioner submits that in fact, the petitioner is not named in the F.I.R. The name of the petitioner has come in the confessional statement of co-accused Aasif Raza. Except that, there is nothing against the petitioner to show his involvement in the present case. Further submission is that petitioner is also accused in four other cases, as detailed in paragraph no.3 of the application, due to that reason the Police has implicated the petitioner in this case on the basis of

Patna High Court Cr.Misc. No.13664 of 2016 (2) dt.19-04-2016 2/2 confession of co-accused. It is also submitted that petitioner is in custody since 12.01.2016.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M. Araria in connection with Araria (Bairgachhi) P.S. Case No. 381 of 2015. Out of two sureties, one surety must be parents or close relatives of the petitioner.
