The petitioner seeks bail in connection with Jandaha P.S. Case No.14 of 2015 for the offences punishable under Sections 399, 402 and 414 of the Indian Penal Code and Sections 25(1-b), 26 and 35 of the Arms Act.
The prosecution story, in brief, is that on 28.01.2015 at about 2.00 A.M. while the informant (Officer Incharge) along with members of the patrolling party was deputed for night patrolling and checking the light vehicle, he received a secret information that some miscreants were sitting in a garden with intention to commit dacoity. The informant proceeded towards Suresh Chowk along with the police party and saw one motorcycle standing near the garden. After seeing the police party, 5-6 miscreants started
Patna High Court Cr.Misc. No.20496 of 2015 (2) dt.11-06-2015 2/2 fleeing away. The police party chassed and caught hold of four persons who disclosed their names as Ram Balak Singh, Mohan Kumar, Sanjay Paswan and the petitioner.
It has been submitted on behalf of the petitioner that as per the first information report, only three cartridges are said to have been recovered from the possession of the petitioner. It has further been submitted that the petitioner has got no criminal antecedent and he is in custody since 28.01.2015 On behalf of the State, it has been submitted that the petitioner is named in the first information report. Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Sri Ravi Kumar, Judicial Magistrate, Ist Class, Vaishali at Hajipur in connection with Jandaha P.S.
