JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 25-04-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Araria (Bairgachhi) P.S. Case No. 234 of 2015, registered under Section 392 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that petitioner is not named in the F.I.R. In course of investigation, the name of the petitioner has come in the confessional statement of accused Sayeed Alam showing his involvement in the present case, except the confessional statement, there is nothing against the petitioner. Further submission is that while petitioner was made accused in Tarbari P.S. Case No. 93 of 2014, under Section 641, 379 and 411 of the Indian Penal Code, but he has been acquitted in the said case.

Sawood Alam @ Saud has already been granted privilege of bail by a co-ordinate Bench of this Court vide order dated 16.12.2015 passed in Criminal Misc. No. 55740 of 2015. The petitioner is in custody since 22.05.2015.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria in connection with Araria (Bairgachhi) P.S.
