JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-05-2019 Petitioner seeks regular bail in connection with Khagaria (Chitragupta Nagar) P.S. Case No.190 of 2019 registered for the offence punishable under Section 30(a) of the Bihar Prohibition & Excise Act, 2016.

Allegation as per F.I.R. against the petitioner is of recovery of 09 bottles each containing 750 ml of Premier Whisky, 40 bottles each containing 180 ml of Royal Stag Premier Whisky and 11 bottles of foreign liquor each containing 375 ml from the shop and house of the petitioner. Submission of the learned counsel for the petitioner is that he has no criminal antecedent and is in custody for about two months and he is ready to abide by the conditions imposed upon him.

No.33210 of 2019(2) dt.20-05-2019 2/2 Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Special Judge, Excise, Khagaria, in connection with Khagaria (Chitragupta Nagar) P.S. Case No.190 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
