Mr. Sanjay Kumar Jha, learned counsel appearing for the petitioner submits that the petitioner preferred Criminal Appeal (SJ) No. 1026 of 2022 which was dismissed however, the petitioner was given a liberty to surrender before the trial court in the next twenty days from the date of that order but the petitioner/appellant could not have surrendered within the stipulated time period as he was on election duty at that time which remained till 04.06.2024 and hence, the petitioner has

Patna High Court CR. MISC. No.38597 of 2024(2) dt.08-07-2024 2/2 prayed to extend the period of surrender for further twenty days as the petitioner is presently posted in Banka District in Police Department, Government of Bihar.

3. Considering the above submission, the petitioner's prayer stands allowed and he is granted further twenty days time to surrender before the trial Court and the surrender period fixed by this Court in the order dated 20.04.2024 will be treated as twenty days from today.

4. Accordingly, the instant Criminal Miscellaneous Petition stands allowed.
