The petitioner has preferred this application for grant of regular bail in a case registered under section 307 and other sections of the Indian Penal Code.
As per the prosecution case, the accused persons are said to have come variously armed and of having assaulted the informant and others. The allegation against the petitioner is of having fired on the informant as a result of which he sustained injuries in his stomach.
It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case for oblique reasons. The injury report which has transpired in course of investigation does not support the prosecution case against the petitioner of having fired. The injury report of the
Patna High Court CR. MISC. No.44434 of 2021(3) dt.21-02-2022 2/2 informant states that he sustained simple injury caused by hard and blunt substance. The petitioner is in custody since 4.6.2021 and has no criminal antecedent. Chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the contents of the injury report of the informant, the petitioner having remained in custody for 8 months and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Kako (Bhelawar) P.S. Case no.143 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jehanabad.
