On getting confidential information regarding running of brothel a raid was conducted and during course thereof, one Md. Kalu son of Late Shankar Khalifa and another Kallu Mian son of Late Bhikhari Rai @ Bhikhari Mian were apprehended and during course of search, one Sushila Kumari, aged about 14 years was recovered. It has also disclosed that on query Sushila had disclosed that she was being forced under flash trade.
Annexure-2 is the statement of Sushila Devi recorded under Section 164 Cr.P.C. After perusal of the same, it is evident that she had completely changed the scenario.
Patna High Court Cr.Misc. No.17056 of 2015 (2) dt.27-04-2015 In the aforesaid facts and circumstances of the case, petitioner Md. Kalu @ Kallu Khalifa @ Kawlu Khalifa, Kallu Mian each are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Sitamarhi P.S. Case No.141 of 2015, subject to condition that the bailors as well as petitioners themselves will file an affidavit that they will not indulge directly or indirectly in such kind of activity, in case so, the privilege of bail will automatically cease.
