The petitioners apprehend their arrest in a case registered for the offence under Sections 379, 411 and 353 of the Indian Penal Code, Rule-56 of Bihar Mines and Minerals (Concession, Prevention of Illegal Mining Transportation and Storage) Rule, 2019 and Rule 15 of the Environment (Protection) Act, 1986.

3. Petitioner no. 1 is owner of the Tractor, from which, 100 cft. illegal sand has been recovered and petitioner no. 2 is brother of petitioner no. 1.

4. It is submitted on behalf of petitioners that

No.39842 of 2023(3) dt.13-12-2023 2/2 petitioner no. 1 has already deposited the fine amount and compounding fee of Rs. 35,650/- in the office of District Mining Officer, Gaya for release of seized Tractor and to this effect, a letter has already been issued from the said office, vide Memo No. 126 dated 13.01.2023 (Annexure - 2 to the bail petition). Petitioners have got clean antecedent.

5. Learned A.P.P. for the State has opposed the bail petition.

6. Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Sherghati (Gaya) in connection with Imamganj P.S. Case No. 6 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
