JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The accusation against the petitioner is that he along with other accused set a fake lady and got transferred the lands of the informant in favour of co-accused Santosh Kumar. Learned counsel for the petitioner points out that one co-accused Lokesh Kumar, having similar allegation, has already been granted privilege of bail by a co-ordinate Bench of this Court. Moreover, petitioner is in jail custody since 11.02.2016 and neither he was transferor nor transferee nor beneficiary of the property.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.16717 of 2016 (2) dt.27-04-2016 2/2 well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran in connection with Chhatauni P.S.Case No. 87 of 2015.
