2. The petitioner seeks regular bail in connection with Sasaram Mufassil P.S. Case No. 26 of 2026 lodged on 26.01.2026, for the offence punishable under Sections 103(1), 238 and 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 27 of Arms Act.
3. Prosecution story, in brief, is that the informant's brother Rupesh Kumar @ Niraj left the house stating that he is going to Tilouthu to meet Vinay Prajapati. Later on, he informed that he is moving toward the house of Pappu Singh on a scorpio of Vinay Prajapati along with a driver Raushal Ali. Later on
Patna High Court CR. MISC. No.34339 of 2026(3) dt.23-07-2026 2/3 driver informed that scorpio owner, Vinay Prajapati and his brother has been killed by Pappu Singh. Thereafter when he reached Pappu Singh's house, he found the dead body of Vinay Prajapati and his brother.
4. Learned counsel for the petitioner submits that the petitioner is innocent and being a government teacher, he has been falsely implicated in this case. Learned counsel for the petitioner further submits that the criminal antecedent of the petitioner is clean and he is in custody since 03.02.2026.
5. Learned counsel for the informant submits that there is specific allegation against the petitioner in the case diary.
6. Learned APP for the State and learned counsel for the informant opposes the prayer for bail of the petitioner.
7. Having heard the parties and perused the case diary. From the perusal of case diary it is evident that no specific role has been assigned to the petitioner but it is only that petitioner has only requested the other co-accused person to look into the matter.
8. Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two

Case No. 26 of 2026, subject to the following conditions: (I) One of the bailors shall be the petitioner's own or close member.
(II) The petitioner shall appear on each and every date fixed during the trial and also co-operate in the process of trial. (III) The petitioner shall not tamper with the prosecution evidence or influence/intimidate any witness during the course of trial.
(IV) The Petitioner shall not commit offence of a similar nature in future.
In case of violation of any of the aforesaid conditions, the Trial Court shall be at liberty to cancel the bail bonds of the petitioner.
