Verma, learned senior counsel, who was assisted by Sri Hirday Narayan Harshit, learned counsel for the petitioner and Dr. Kumar Uday Pratap, learned A.P.P. This is third attempt for grant of bail on behalf of the petitioner in connection with Phulparas P.S. Case No. 203 of 2013, G.R. No. 1194 of 2013, T.R. No. 2549 of 2014 registered for the offence under Section 409 and 420 of the Indian Penal Code.

Earlier, since the petitioner had moved second time for grant of bail even before expiry of six months, this court declined to entertain the petition, and as such, learned counsel for the petitioner on 25.3.2015 sought permission to withdraw the petition and after completion of six months from the date of earlier

Patna High Court Cr.Misc. No.22413 of 2015 (2) dt.13-05-2015 2/2 rejection of the bail petition the present bail petition has again been filed. The petitioner is in custody since 1st January, 2014. Keeping in view the period of custody, let the petitioner namely Chandra Bhushan @ Chandra Bhushan Yadav be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Jhanjharpur, District- Madhubani in connection with Phulparas Police Station Case No. 203 of 2013, G.R. No. 1194 of 2013, T.R. No. 2549 of 2014 on a condition that one of the bailors must be blood relative of the petitioner and secondly on each and every date during the trial the petitioner shall remain physically present. If continuously on two dates he remains absent without prior permission of the trial court, his bail bond shall stand automatically cancelled.
