Petitioner being husband of the deceased is languishing in jail custody since 17.8.2014 in a case initially, registered under sections 304B, 120B/34 of the Indian Penal Code but after investigation, police submitted charge sheet for the offence punishable under section 304 of the Indian Penal Code.

In course of investigation, co-villager of the petitioner stated that on account of petty family feud, petitioner gave one slap to the deceased as a result of which she fell on the ground and thereafter, deceased was taken to hospital but before reaching hospital, she died. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like
