Learned counsel for the petitioner is directed to remove the defects within four weeks.
The petitioner apprehends her arrest in a case registered for the offence punishable u/s 420, 406, 409/34 of the IPC. Allegedly, the local members including the petitioner (Ward Member), Mukhiya and Panchayat Sachiv of Dihri Panchayat are said to have misused their authority and executed the Government schemes in an arbitrary manner and withdraw the entire money allotted for execution of schemes without ensuring the completion of work thereby causing huge loss to the public exchequer.
It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. She has been falsely implicated in this case. No such occurrence, in
Patna High Court CR. MISC. No.35030 of 2022(2) dt.27-09-2022 2/2 the manner as alleged, has ever taken place. Petitioner is the Ward Member of Ward No.4 of Dihra Panchayat. The allegation leveled against the petitioner is not specific rather general and omnibus in nature. Petitioner has no criminal antecedent and several similarly situated co-accused persons have been enlarged on anticipatory bail by this Court vide order dated 07.07.2022, passed in Cr. Misc. No.58995 of 2021 and vide order dated 04.08.2022 passed in Cr. Misc. No.12882 of 2022 with Cr. Misc. No.13772 of 2022.
Learned APP for the State opposed the prayer for bail. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of her arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Bhabhua P.S. Case No.284 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Anjani Kumar Sharan, J) pallavi/- U T
