JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-04-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners and some other accused are named in the first information report on the accusation that on the alleged date of occurrence, they took the deceased from his house and in the next morning, the dead body of the deceased was found on a Railway track.

From perusal of the impugned order, it would appear that none has seen the actual killing of the deceased and, at best, it is a case of last seen. Moreover, it is submitted on behalf of the petitioners that the daughter of co-accused Jagrnath Ram @ Jagarnath Rai was in love with the deceased and the informant was

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate,-XIII, Vaishali at Hajipur in connection with Sarai P.S.case No. 149 of 2015.
