The petitioner is accused in connection with Garkha P.S. Case No. 242 of 2014 registered under Sections 25(1-B)a/ 26(ii) of the Arms Act.
The accusation is of recovery of one country made carbine along with one magazine containing a 9mm live cartridge from possession of the petitioner.
Learned counsel for the petitioner submits that alleged recovered carbine was found in rustee and was not working properly. As on making firing, there is a chance of danger to the person, who making firing. It is further submitted that petitioner
Patna High Court Cr.Misc. No.20236 of 2015 (3) dt.16-09-2015 has no criminal antecedent and is in custody since 22.12.2014. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran at Chapra in connection with Garkha P.S.
