The petitioner is languishing in custody since 18.04.2014 in a case registered for the offences punishable under Sections 376/511, 302 of the Indian Penal Code and 3(2)(x) of SC/ST (Prevention of Atrocities) Act.

It is alleged against the petitioner that the petitioner assaulted indiscriminately with axe to the wife of the informant, who subsequently succumbed to the injury. The impugned order reflects that the trial is at advance stage as out of eight charge-sheeted witnesses six witnesses have already been examined.

Considering the state of trial, this Court is not inclined to grant bail to the petitioner in connection

Patna High Court Cr.Misc. No.22463 of 2015 (2) dt.10-07-2015 2/2 with Sessions Trial No. 300 of 2014/44 of 2014 arising out of Adhaura P.S. Case No. 10 of 2014 pending in the court of learned Sessions Judge, Kaimur at Bhabua.

Accordingly, the prayer for bail of the petitioner is rejected.

It is expected from the learned trial court to expedite the trial.
