JUSTICE DINESH KUMAR SINGH ORAL ORDER 25-06-2015 Heard learned counsels for the petitioner and learned APP for the State.
The petitioner is languishing in custody since 28.02.2015 in case registered for the offences punishable under section 395 of the Indian Penal Code.
It is alleged that theft was committed in the jewellery shop of the informant leading to registration of the FIR against unknown. The name of the petitioner sprang up on the confession of the co-accused Bisnu Deo Sahni, who suggested that he sold the stolen jewellery to this petitioner. It is submitted by learned counsel for the petitioner that even assuming the confession of co-accused at best the offence under section 411 IPC is made out against the petitioner.
Patna High Court Cr.Misc. No.20318 of 2015 (3) dt.25-06-2015 2/2 Considering the fact that investigation has already concluded, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with Keoti P.S. Case No.175 of 2014.
