JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. According to the prosecution case itself, the firing was made by unknown persons and it is stated that it was petitioner, who managed the unknown persons to commit the alleged crime. Petitioner does have criminal antecedent of near about 20 cases but submission on behalf of the petitioner is that much prior to the alleged occurrence, the brother of the petitioner was killed by the informant and his family members for which a criminal case was lodged and the cousin of the informant was convicted in the aforesaid criminal case and that is the reason, the informant implicated the petitioner in the alleged crime. It is further submitted that so far as criminal antecedent of the petitioner is

Patna High Court Cr.Misc. No.15721 of 2016 (2) dt.19-04-2016 2/2 concerned, earlier petitioner was made accused in another case but, later on, in collusion with the informant, the police lodged the present case and got the petitioner made accused in several other cases.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional District Judge, 1st Jamui in connection Jamui Nagar P.S.Case No. 237 of 2015.
