Heard learned counsel for the petitioner, learned APP for the State, Shri Chandra Bhushan Prasad and the learned counsel appearing on behalf of the informant, Shri Sangeet Deokuliar.

The S.H.O, Kotwali Police Station and the Investigating Officer of the case, in compliance of the order dated 20-8-2025, are present in the Court.

The SHO submits that he has recently joined and was not aware of the case.

The Investigating Officer accepts that notice under Section 35 BNSS has not been issued to the petitioner. 5.

The SHO assures the Court that by tomorrow notice under Section 35 BNSS shall be served on the petitioner.

Learned counsel appearing on behalf of the petitioner submits that in the event if notice under Section 35 BNSS is served on the petitioner, he will accept the same. Learned counsel for the petitioner thus submits that for the present, petitioner does not have any apprehension of arrest hence seeks permission to withdraw the anticipatory bail application with liberty to file afresh, if need arises. 7.

Permission is accorded.

Accordingly, the anticipatory bail application is dismissed as withdrawn with the liberty aforesaid. 9.

The personal appearance of the S.H.O, Kotwali Police Station and the Investigating Officer of the case, is dispensed with.
