JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 03-07-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor assisted by learned counsel for the informant. On trivial issue, the parties quarreled and then, as has been alleged the accused persons including petitioner armed variously came. They assaulted the prosecution party. Petitioner, Yogendra Singh as well as Prem Singh who were armed with gun began to fire, indiscriminately causing injuries over person of Yogendra Mahto, Jivan Mahto, Sugriv Kahar, Akhilesh Mahto, Lalan Mahto, Runa Devi, Manju Devi including informant Ranjan Kumar Mahto.

Annexure-3 Series is the injuries report of respective injured wherefrom it is evident that Yogendra Mahto sustained single injury caused by hard and blunt substance, simple in nature while Shailendra Bind, Runa Devi, Lalan Mahto, Jitan Mahto, Ratan Mahto, Akhilesh Mahto and Manju Devi have sustained pellet injuries however, simple in nature. Furthermore, for the aforesaid eventualities petitioner along with Prem Singh have conjointly been identified.

Patna High Court Cr.Misc. No.20562 of 2015 (3) dt.03-07-2015 In the facts and circumstances of the case petitioner, Yogendra Singh is directed to be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Manjhi P.S.
