JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-09-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30a of the Bihar Prohibition.

Prosecution case is that 145.200 liters Nepali Saufi Wine was seized by the police while being unloaded from a vehicle. Petitioner and co-accused Munna Yadav managed to escape from the place of recovery.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery which has been made from open place.

Learned counsel for the State submits that the petitioner is accused in three criminal cases and there is allegation in the FIR that he along with other accused persons was engaged in illegal liquor trade.

Considering the facts of the case, this application for grant of anticipatory bail to the petitioner is refused with
