JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 16-09-2015 Heard learned counsel for the petitioners, learned A.P.P. for the State and learned counsel for the informant. The petitioners seek bail in connection with Dalsinghsarai P.S. Case No. 78 of 2015 registered under Sections 147, 148, 149, 323, 324, 326A, 307, 504 and 34 of the I.P.C. The accusation is that in course of land dispute, petitioners Soni Poddar and Lal Muni Devi threw acid at informant and others causing burn injury.
Learned counsel appearing on behalf of the petitioners submits that in fact, there was land dispute in between the parties, in that course, the prosecution party threw the acid at the petitioners regarding which Dalsingsarai P.S. Case No. 79 of 2015 has been instituted by the petitioner Lal Muni Devi against
Patna High Court Cr.Misc. No.20558 of 2015 (4) dt.16-09-2015 2/2 the informant and others. It is further submitted that injuries, as detailed in the case diary, are said to be of acid injury but are simple in nature. It is also submitted that petitioners are in custody since 24.02.2015.
Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the A.C.J.M., Dalsinghsarai in connection with Dalsinghsarai P.S. Case No. 78 of 2015(G.R. Case No. 144 of 2015).
