Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Grakha P.S. Case No. 138 of 2021 registered for the offences punishable under Sections 135 of the Indian Electricity Act.

The allegation against the petitioner is of electricity theft.

Patna High Court CR. MISC. No.43765 of 2021(2) dt.23-05-2022 2/3 The petitioner is granted anticipatory bail if he deposits the entire amount of Rs. 4,50,000/- (Rupees Four Lakhs Fifty Thousand) within a year in installments.

The bail bond of the petitioner shall be accepted when the first installment is paid by the petitioner within six weeks thereafter the court below shall grant him interim bail which shall be confirmed only after the entire amount is deposited within a year. If the petitioner applies for electric connection after payment of the first installment, the Board is directed to consider the same in accordance with law.

Considering the facts and circumstances of the case, the present anticipatory bail application is allowed. Accordingly, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (Electricity) N.B.P.D.C.L., Tirhut Area, Muzaffarpur, in connection with Garkha P.S. Case No. 138/2021, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
