Nobody appears on behalf of the respondents.

This I.A. has been filed for disposal of the present Second Appeal in terms of compromise as stated in para 4 of the petition that the appellants and the respondent have compromised the case outside the Court on the following terms and conditions:- (a) The respondent Md. Sajid Ahmad has vacated the tenanted premises and handed over vacant possession of the same to the plaintiffs-appellants who have come in possession of the same.

(b) The plaintiffs-appellants have relinquished their claim with regard to arrears of rent due from the

Patna High Court SA No.216 of 2004 dt.07-01-2019 2/2 defendant-respondent and undertake not to claim arrears of rent in respect to the suit premises. (c) Now both the parties have no grievance or claim against each other.

(d) That the appellants and the respondent pray that the present compromise petition kindly be accepted and the present Second Appeal may kindly be disposed of on the basis of the terms of the compromise mentioned above.

Having considered the facts aforesaid, the present Second Appeal is disposed of in terms of compromise as stated in para 4 of I.A. No.5282 of 2018.

I.A. No.5282 of 2018 stands allowed.
