JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-04-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 14.11.2014 in a case registered for the offences punishable under Sections 341, 342, 323, 376, 511/34 of the Indian Penal Code on the accusation that he along with four others caught the informant and her younger sister and made attempt to establish physical relation with the informant.
The contention on behalf of the petitioner is that petitioner is agnate of Dipesh Prajapati and as a matter of fact, the informant has been set up by the aforesaid Dipesh Prajapati. It is further contended by him that petitioner was not caught on the spot rather he was arrested by the police from his village.
Patna High Court Cr.Misc. No.5694 of 2015 (3) dt.28-04-2015 Considering the aforesaid facts and circumstances as well as period of detention of the petitioner in jail custody, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge, Gopalganj in connection with Bhorey P.S.
