The petitioner seeks bail in a case instituted for the offences under Sections 341, 323, 354(a), 354(d), 509 of the Indian Penal Code and 12 of POCSO Act.

The prosecution case in short is that the accused persons outrage the modesty of the informant and on protest, her family members were assaulted by the accused persons. It has been submitted on behalf of the petitioners that the petitioners are in custody since 13.4.2019 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has

Patna High Court CR. MISC. No.31575 of 2019(2) dt.13-05-2019 2/2 falsely been implicated in the present case due to previous enmity. The parties are co-villagers. The allegations made in the F.I.R. is denied.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-I-cum- Special Judge, Buxar in connection with POCSO Case No. 16/2019 arising out of Itarhi P.S. Case No. 93 of 2019.
