Petitioner seeks bail in a case registered under section 302/34 of the Indian Penal Code as well as section 27 of the Arms Act.

Informant claimed, himself, to be eye-witness of the alleged occurrence and specifically, stated in the fardbeyan that FIR named accused committed murder of the deceased but in course of investigation, name of the petitioner came in this case in the confessional statement of co- accused and it also came to light that deceased had illicit relation with cousin sister of the petitioner and that was the reason of murder of the deceased. Moreover, FIR named accused have already been acquitted and having more or less similar allegation one co-accused Subham Kumar has already been granted privilege of bail by this court whereas petitioner is in jail custody since 9.2.2016.

Patna High Court Cr.Misc. No.15467 of 2016 (2) dt.18-04-2016 Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai in Begusarai Town P.S.
