The petitioner being the husband of the informant is languishing in custody in a case registered for the offences punishable under Sections 341, 323, 498A and 504/34 of the Indian Penal Code.

The basic accusation is of torture.

It is submitted by learned counsel for the petitioner that after 12 years of the marriage the accusation has been levelled when two female children were born from the wedlock.
