JUSTICE SHIVAJI PANDEY ORAL ORDER 13-07-2016 The petitioner was earlier granted bail vide order dated 29.02.2016 passed in Criminal Miscellaneous No.6424 of 2016 subject to payment of Rs.1 lakh within a period of fortnight from the date of release, as he could not comply the said order he filed the present application for modification of said order. An affidavit has been filed by the Bank, wherein it has been mentioned that an amount of Rs.47,072/- as on 27.06.2016 is outstanding dues against the present petitioner. Let the aforesaid amount be treated as final outstanding dues against the petitioner.
The petitioner is ready to pay back the aforesaid amount in two installments. The petitioner is directed to pay the
Patna High Court Cr.Misc. No.13958 of 2016 (3) dt.13-07-2016 2/2 amount in two installments. The petitioner would pay first installment by 1st of August, 2016 and second installment by 1st of September, 2016.
In such view of the matter, if the petitioner pays the amount, as indicated above, in two installments, it will be treated that he has complied the order dated 29.02.2016 passed in Criminal Miscellaneous No.6424 of 2016. It is made clear that if the petitioner fails to pay the aforesaid amount, the bail granted to the petitioner will be treated to be cancelled. The order dated 29.02.2016 passed in Criminal Miscellaneous No.6424 of 2016 is modified to the above extent. This modification application stands disposed of. (Shivaji Pandey, J) pawan/- U T
