The petitioner seeks bail in connection with Madhuban P.S. Case No. 220 of 2019, dated 02.10.2019, instituted for the offences under Sections 413 and 414 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act.
Patna High Court CR. MISC. No.33529 of 2020(2) dt.16-12-2020 2/3 The prayer for bail of the petitioner was earlier rejected vide order dated 20.02.2020 passed in Cr. Misc. No. 7914 of 2020. However, the petitioner was given the liberty to renew his prayer for bail after framing of the charge.
It has been submitted on behalf of the petitioner that despite his remaining in custody since 03.10.2019, charges have also yet not been framed which may perhaps be because of Covid-19 pandemic prevailing world over. It has further been submitted that the petitioner was made accused in four cases, but in all such cases, he is on bail.
Regard being had to the fact that there was recovery of pistol and cartridges from the possession of the petitioner and for which he has remained in custody from 03.10.2019, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 4th Additional Chief Judicial Magistrate, East Champaran, Motihari in connection with
Patna High Court CR. MISC. No.33529 of 2020(2) dt.16-12-2020 3/3 Madhuban P.S. Case No. 220 of 2019.
While saying so, this Court has also taken note of the fact that till date, the charges have not been framed in this case.
