JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 24.12.2014 in a case registered for the offences punishable under Sections 399,402,384,420 and 414/34 of the Indian Penal Code and section 25(1-B)a 26 and 35 of the Arms Act. On information that the miscreants are preparing to commit dacoity, raid was laid when petitioner was apprehended though others managed to escape from the scene and from the possession of the petitioner loaded country made pistol, two live cartridges and mobile were recovered.

It is submitted by the learned counsel for the petitioner that the investigation has already concluded. Considering the aforesaid facts, let the above named

Patna High Court Cr.Misc. No.23477 of 2015 (2) dt.13-07-2015 2/2 petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Patna in connection with Daniyawan P.S. Case No. 100 of 2014.

Considering the criminal antecedent of the petitioner, the learned court below shall be at liberty to cancel the bail bonds of the petitioner in case the petitioner gets involved in serious offence or defaults without any reasonable cause on two consecutive occasions.
