This application has been filed for grant of regular bail in connection with Barachatti P.S. Case No. 141 of 2023 registered for the offence under Section 414 of the Indian Penal Code and Section 25(1-b)a /26 of the Arms Act. As per the prosecution case, from the house of coaccused Ramanand Paswan, where the petitioner has his in-laws house, a country made fire arm, two cartridges and one motorcycle were recovered in raid conducted by the police in search of the petitioner.
Learned counsel for the petitioner submits that nothing has been recovered from the possession of the petitioner or from his house rather the recovery was made from the house
Patna High Court CR. MISC. No.35020 of 2023(2) dt.07-07-2023 2/2 of the co-accused Ramanand Paswan. He has no concern with the recovered articles and the police has falsely implicated him in this case. The petitioner is in jail custody since 14.02.2023. He has one criminal antecedent. He has himself surrendered before the Court.
Learned APP for the State has opposed the prayer of bail.
Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. - II, Sherghati District - Gaya in connection with Barachatti P.S. Case No. 141 of 2023.
