JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-05-2016 The petitioner being elder brother of the husband of the informant is languishing in custody since 07.11.2015 in a case registered for the offences punishable under Sections 341, 342, 323, 307, 328, 498A/34 of the Indian Penal Code, subsequently Section 302 I.P.C was also added. The prosecution case is that the informant was residing with her father in the house of her husband Arun Paswan. The husband of the informant Arun Paswan came with some intoxicated sweets and thereafter he dragged her by putting towel around her neck and assaulted thrice with knife on the back. It is alleged against this petitioner and Pappu Paswan that they directed the informant's husband to give one more knife blow. Subsequently the informant succumbed to the injuries.
It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.13821 of 2016 (3) dt.02-05-2016 2/2 petitioner that for the occurrence of 24.10.2015 the F.I.R was registered on 06.11.2015. The assailant is the husband of the victim. Though the petitioner along with one Pappu Paswan directed the husband of the victim to give one more knife blow but no subsequent blow was given by the husband of the victim. Moreover the investigation has already concluded. Considering the fact that thrust of accusation is against the husband of the informant, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Sikarahana at Dhaka, East Champaran in connection with Ghorasahan P.S.
