2. The petitioner seeks regular bail in connection with Fatehpur P.S. Case No. 74 of 2026, registered under Sections 70(1), 351(1), 351(2) of the B.N.S.
3. As per prosecution, the allegation is that the petitioner raped the informant. The medical report has not supported the factum of rape. The petitioner has brought on record Annexure-2 which is an FIR lodged on 24.09.2024 where he has alleged that his father was killed by six persons including the husband of the informant who is at Serial No. 1.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the
Patna High Court CR. MISC. No.34866 of 2026(2) dt.20-05-2026 2/3 present case. The name of the petitioner has transpired in this case on the confessional statement of co-accused persons. Learned counsel further submits that for saving her husband from the aforesaid case, the instant false case has been lodged. The petitioner has clean antecedent and he is in custody since 10.02.2026.
5. Learned APP for the State has vehemently opposes the prayer for bail of the petitioner.
6. Considering that the allegation has been levelled in the backdrop that the husband of the informant is accused in the murder case of father of the petitioner, this bail application is allowed.
7. Accordingly, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gayaji /concerned court below in connection with Fatehpur P.S. Case No. 74 of 2026.
8. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application. Such observations shall not be construed as an expression on the merits of the case
