The petitioner seeks bail in Sheohar P.S.Case No. 12 of 2014 under Sections 406, 409 and other sections of the Indian Penal Code.

Ravikant Ojha, the Supervisor of S.I.S. Company, alleged that the petitioner and one Vikash Kumar were entrusted to take money from the Bank in order to stock in the concerned ATM of the Bank. The petitioner took an amount of Rs.1,45,000/- but did not stock the same in the ATM.

It is submitted that after auditing it was found that Rs.1,05,000/- was short and the same was not stocked in the ATM. The petitioner and Vikash Kumar misappropriated the entire amount. But the petitioner is ready to deposit the same within two

Patna High Court Cr.Misc. No.20635 of 2015 (6) dt.17-06-2015 months from the date of his release and the petitioner is in jail since 17.11.2014.

The prayer for bail of co-accused Vikash Kumar had already been rejected vide Cr.Misc.No. 7385 of 2015 because he was not ready to deposit the same.

Considering the fact that the petitioner is ready to deposit the entire amount in the Bank concerned within two months from the date of his release and the petitioner is in jail since 17.11.2014, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sheohar, in connection with Sheohar P.S.Case No. 12 of 2014.

If the petitioner does not deposit the amount of Rs.1,05,000/- within two months from the date of his release, the learned court below shall cancel the bail bond of the petitioner. (Prabhat Kumar Jha, J) spal/- U
