The petitioner seeks bail in Rajgir P.S. Case No. 343/2018, instituted for offences under Section(s) 147, 148, 149, 323, 341, 342, 307 and 302 of the Indian Penal Code read with Section 27 of Arms Act.

Learned counsel for the petitioner has submitted that there is no allegation of overt act against this petitioner in the written report. There is specific allegation against co-accused Vijay Singh of making firing with pistol upon father of informant causing injury near his right ear. Rahul Singh and Avinash Singh made firing on the chest of Sanjeev Kumar Singh (cousin brother of informant). Karu Singh @ Navin Singh made firing on the neck of Sanjeev Kumar Singh. Thereafter father

Patna High Court CR. MISC. No.32416 of 2019(2) dt.16-07-2019 2/2 and cousin brother of informant fell down on the ground and subsequently died on the spot.

As per written report, there is no allegation of overt act against this petitioner.

Learned counsel for the informant opposed the prayer for bail of petitioner.

Petitioner is in custody since 02.02.2019.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda, in connection with Rajgir P.S. Case No. 343/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
