JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-02-2021 Heard learned counsel for the petitioner as well as learned counsel for the State through video conferencing. The petitioner seeks bail in Kopa Police Station Case No. 52 of 2018 registered for the offences punishable under sections 304B/302/498A of the IPC.

Petitioner happens to be the husband of the deceased and it is alleged that he along with his family members subjected the deceased to cruelty and harassment for nonfulfilment of dowry demand and finally they killed her by administering poison.

Learned counsel for the petitioner submits that the petitioner is a innocent and the victim died of snake bite. The due intimation was also given to her family including the informant and the instant case has been filed to extort money.

Patna High Court CR. MISC. No.35627 of 2020(3) dt.01-02-2021 2/2 Petitioner has got no criminal antecedent and he is in custody since 22.1.2020. Charge sheet has already been submitted. Learned counsel for the State opposes the prayer for bail and submits that the petitioner is husband of the deceased who died under unnatural circumstances at her matrimonial house within seven years of marriage.

In view of the gravity of the allegation alleged in the FIR, prayer for bail of the petitioner is refused. (Prabhat Kumar Singh, J) Shashi U T
