JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-04-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The Trial Court has reported that the trial of the petitioner has already been commenced and three prosecution witnesses have already been examined. So far as remaining prosecution witnesses are concerned, the steps have already been taken to procure their attendance.
No doubt, the petitioner is in jail for more than three years but admittedly, the charge against the petitioner could be framed on 14.10.2014.
Considering the aforesaid facts and circumstances as well as submissions of the parties, again, I am not inclined to

No.6970 of 2015 (3) dt.29-04-2015 2 / 2 release the petitioner on bail in connection with Sessions Trial No. 376 of 2012/ 261 of 2014, arising out of Wazirganj (Tankuppa O.P.)P.S. Case No. 162 of 2011, pending in the court of the learned Adhoc Additional District Judge-II, Gaya, at this stage. Accordingly, his prayer for bail stands rejected. However, the Trial Court is directed to conclude the trial of the petitioner within six months from the date of receipt/production of copy of this order failing which, the petitioner shall be at liberty to renew his prayer for bail before the learned Trial Court itself. Let a copy of this order be sent to the Senior Superintendent of Police, Gaya, with direction to him to ensure the presence of remaining prosecution witnesses in the above stated case before the court of learned Adhoc Additional District JudgeII, Gaya, within two months from the date of receipt/production of copy of this order.
