JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-395 of the Indian Penal Code.

Petitioner is not named in the first information report but in course of investigation, some witnesses stated about the involvement of the petitioner and others in the alleged crime. Contention on behalf of the petitioner is that having similar allegation, one co-accused namely, Vivek Kumar has already been granted privilege of bail by a coordinate bench of this court. Moreover, except the aforesaid fact as well as some criminal antecedent of the petitioner, there is nothing against him. Petitioner is languishing in jail custody since 20-02-

Patna High Court Cr.Misc. No.14214 of 2016 (2) dt.05-04-2016 2/2 2015 but it appears from the impugned order that uptill now, the I.O. could not take pain to put the petitioner on test identification parade.

Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Bakhtiyarpur P.S. Case No. 283 of 2014 corresponding to Sessions Trial No. 503 of 2015 to the satisfaction of Learned Additional Sessions Judge-VIth , Barh, Patna. (Hemant Kumar Srivastava, J) A.K.V./- U T
