Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Supaul P.S. Case No. 748 of 2022 registered for the offence under Sections 7 of the E.C. Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 13.03.2023 and he is innocent and he has falsely been implicated in this case only on suspicion. Learned A.P.P. has vehemently opposed the prayer for bail.

The allegation against the petitioner is that he has sold the fertilizer at higher price than the fixed price as fixed by

Patna High Court CR. MISC. No.38584 of 2023(2) dt.05-07-2023 2/2 Government.

Considering the aforesaid facts and the period of custody, this application for regular bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Supaul/concerned Court below in connection with Supaul P.S. Case No. 748 of 2022.

This application stands allowed.
