The petitioner is languishing in custody since 02.08.2013 in a case registered for the offences punishable under section 395 of the Indian Penal Code.
Accusation is of robbing the informant leading to registration of FIR against unknown. The name of the petitioner sprang up during investigation.
It is submitted by learned counsel for the petitioner that neither the petitioner has been put on TIP nor any robbed article has been recovered from the possession of the petitioner, statements to that effect have been made at paragraphs 7 and 8 of the petition. Statement has also been made in paragraph 3 of the petition that the
Patna High Court Cr.Misc. No.22330 of 2015 (2) dt.07-07-2015 2/2 petitioner has no criminal antecedent.
Considering the aforesaid fact, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Sadar, Motihari, East Champaran in connection with Mehsi P.S. Case No.157 of 2011.
