The petitioner seeks bail in anticipation of his arrest in connection with Gobindganj (Areraj) P.S. Case No. 271 of 2020 instituted for the offences under Sections 272 and 273 of the Indian Penal Code and Section 30 (a) of the Bihar Prohibition and Excise Act, 2018.

Though a very small amount of liquor is said to have been recovered from the possession of the petitioner but considering the fact that the petitioner was earlier made accused in a case of similar nature, I am not inclined to grant anticipatory bail to the petitioner.

However, if the petitioner surrenders before the Court below and seeks bail, that petition shall be considered on its own merits without being prejudiced by the fact that the present petition for grant of anticipatory bail has not been entertained.
