JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 29-04-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in connection with Bathnaha P.S. Case No. 114 of 2014 registered for the offences punishable under sections 399 and 402 of the Indian Penal Code and 25(1-B)(a), 26 and 35 of the Arms Act.

The prayer for bail of the petitioner was earlier rejected by this Court vide order dated 26.09.2014 passed in Cr.Misc. No.35626 of 2014 with following observations :- "The learned Chief Judicial Magistrate, Sitamarhi is directed to conclude the trial as early as possible preferably within six months from the date of receipt/production of a copy of this order, failing which the petitioner would be entitled to renew his prayer for bail."

Patna High Court Cr.Misc. No.19127 of 2015 (2) dt.29-04-2015 2/2 It has been contended that the petitioner is in custody since 5th April, 2014 and till date charges have not been framed in the case.

Regard being had to the observations made in the aforementioned order dated 26.09.2014, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Bathnaha P.S. Case No.114 of 2014.
